ไบโอไทยพบการจดสิทธิบัตรกระท่อมของญี่ปุ่นได้ใช้งานวิจัยร่วมที่ทำกับนักวิจัยคณะเภสัชศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย อย่างน้อย 15 งานวิจัย โดยมีหลักฐานยืนยันจากเอกสารของมหาวิทยาลัยชิบะว่า ใช้กระท่อมของไทยในการวิจัยอย่างชัดเจน

ภายใต้อนุสัญญาว่าด้วยความหลากหลายทางชีวภาพ(CBD)ซึ่งมีผลบังคับใช้ตั้งแต่ปี 1993 เป็นต้นมา การเข้าถึงและใช้ประโยชน์จากทรัพยากรชีวภาพและภูมิปัญญาท้องถิ่นต้องแจ้งให้ทราบล่วงหน้า(Prior Informed Concent) มีความตกลงร่วมกัน (Mutually Agreed Terms) และมีการแบ่งปันผลประโยชน์อย่างเท่าเทียมเป็นธรรม (Fair and Equitable Sharing of Benefits)

ญี่ปุ่นได้ให้สัตยาบันในอนุสัญญาซึ่งมีผลผูกพันต่อรัฐภาคีนี้ตั้งแต่ปี 1993 ส่วนไทยได้ให้สัตยาบันในปี 2003 ดังนั้นการวิจัยเพื่อใช้ประโยชน์จากสมุนไพรและภูมิปัญญาเกี่ยวกับสมุนไพรไทยต้องเป็นไปตามกฎหมายระหว่างประเทศดังกล่าว

ไบโอไทยพบว่า คณะนักวิจัยจากญี่ปุ่น ซึ่งนำโดย Hiromitsu Takayama มีความร่วมมือในการวิจัยในกระท่อมร่วมกับคณะเภสัชศาสตร์ จุฬาลงกรณ์มหาวิทยาลัยมานานนับตั้งแต่ปี 1994 เป็นต้นมา โดยมีงานวิจัยที่ Takayama ทำงานวิจัยเรื่องกระท่อมร่วมกับนักวิจัยไทยนั้นมีอย่างน้อยถึง 15 งานวิจัยระหว่างปี 1994-2007 ดังรายละเอียดต่อไปนี้

ยังมีหลักฐานอื่นอีกที่เขียนโดย Takayama เองที่ตีพิมพ์ในวารสาร Chem. Pharm. Bull. 52(8) 916—928 (2004) เรื่อง Chemistry and Pharmacology of Analgesic Indole Alkaloids from the Rubiaceous Plant, Mitragyna speciosa ว่า ตัวอย่างในการค้นหาสารสกัดจากกระท่อมนั้นได้จาก “ต้นกระท่อมซึ่งปลูกอยู่ในคณะเภสัชศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย” (หน้า 916)

นี่คือหลักฐานที่กรมทรัพย์สินทางปัญญา กระทรวงพาณิชย์ กรมวิชาการเกษตร กระทรวงเกษตรและสหกรณ์และหน่วยงานที่เกี่ยวข้อง ต้องใช้เป็นหลักฐานในการดำเนินการ เพื่อให้บริษัทมหาวิทยาลัยชิบะ และมหาวิทยาลัยโจไซ ต้องมีการแบ่งปันผลประโยชน์อย่างเป็นธรรม เพื่อให้เป็นไปตามกฎหมายระหว่างประเทศที่ทั้งสองประเทศและกฎหมายของไทยเอง
